我国图书馆版权作品使用规则的私人创制——从“受控数字借阅（CDL）”本土化发展切入

摘要：

“受控数字借阅”作为由图书馆发起的针对本行业的版权作品使用规则，体现出美国图书馆界基于DMCA 框架对版权作品使用规则的私人创制。“受控数字借阅”对图书馆数字化转型的意义、数字资源利用的著作权限制以及与网络服务商合作开展馆藏文献大规模数字化项目实施受阻构成了图书馆“受控数字借阅”产生与发展的动因。我国图书馆“受控数字借阅”本土化发展可以从法律与市场两方面寻求正当性路径，在此过程中需要图书馆界立足行业发展特征采取相应的应对策略。

Abstract:

As a rule for the use of copyright works in this industry initiated by libraries, “ControlledDigital Lending (CDL)” demonstrates the initiative efforts of American library community to create rulesfor the use of copyright works based on the DMCA framework. There are three motivations for creatingCDL: significance to digital transformation of library, copyright restrictions on the utilization of digitalresources, and the hindrance facing the large-scale digitization process when library cooperates with theInternet service providers. The localization CDL in Chinese libraries can seek legitimacy paths from bothlegal and market perspectives. In this process, the library industry needs to adopt corresponding responsestrategies based on the characteristics of industry development.
