Practices and Exploration of Introducing the Management Model of Copyright Right Mark in Foreign Libraries

摘要: 系统梳理和回顾近年来美国、日本等国的文化机构保护馆藏资源的新举措及公开发布数字档案的新方法,旨在从知识产权保护管理方面,为国内该领域的进一步研究与实践探索提供参考。国外图书馆以往在提供数字化信息服务之际,对馆藏数字资源采用CC 协议中的版权权利进行管理。一些国家的图书馆为改善过去所使用CC 协议的不足,同时引进Rights Statements 标记方式作为补充。根据著作权人作品的具体情况,采用不同的保护应对方法,以践行保护知识产权的宗旨。文章对CC 协议、Rights Statements 中两种标记方式进行比较与评估,就实践中如何合理应用与改进创新进行探索。

Abstract: This paper systematically reviews the new measures of cultural institutions in the United States, Japan and other countries in recent years to protect the collection resources and the new methods of public release of digital archives, in order to provide reference for further research and practical exploration in this field. Foreign libraries used to rely on the sign of Creative Commons license to manage the digital resources when providing digital information service. In order to overcome the shortcomings of the Creative Commons license used in the past, some national libraries introduced the Rights Statements logo as a supplement. Dependent on the copyright owners’ works, libraries should adopt different protection methods to serve the purpose of protecting intellectual property rights. This paper compares and evaluates the two marking methods in Creative Commons license and Rights Statements, and exploreshow to apply and improve innovation reasonably in practice.
