Legal Regulation of Data Governance: EU Legislation and the  Chinese Solution : Analysis and Reflection Based on the EU Data Governance Act

Abstract:

The European Union has promulgated the first internationally significant  benchmark DataGovernance Act DGA and other related laws forming a relatively complete legal and regulatory systemfor data governance which has had a significant impact on global data governance legislation andregulation and has great theoretical value and reference significance for China. Using literature reviewand comparative methods this paper first sorts out and reviews the current research literature to identifyresearch breakthroughs. It then elaborates on the main content and characteristics of the EU DGA andprovides an objective evaluation. It compares the legislative situation between China and Europe andanalyzes the applicability of EU experience to China. Finally a  Chinese solution to data governanceregulation is proposed. The conclusion suggests that the  China Plan can be implemented from thefollowing four aspects relying on laws to safeguard China‘ s data governance and introducing a DataGovernance Act when conditions are mature implement the Data Security Act and establishing a datagovernance model in China based on  data security drawing on the data intermediary system of theEuropean Union and improving relevant legislation in China to promote data sharing and circulation andstrengthening the supervision of various aspects of data governance in China and improving the efficiencyof data governance work.
