Research on Limitations and Exceptions of Technical Measures for Long-term Preservation of Library Digital Resources: Considerations Based on the “Technical Path” of Copyright Protection

Abstract: The expansion of rights brought by the protection of technological measures challenges the long-term preservation of digital resources in libraries. Since the WCT and WPPT recognized the protection of technical measures in 1996, European and American copyright legislation, while implementing this principle, have set limitations and exceptions to technical measures for libraries to meet the needs of library development in the digital age. Based on a theoretical analysis of the nature of technical measures and the protection of copyright technical measures, the article compares the relevant legislative practices of the United States, the European Union, and China. This paper holds that there is inadaptability between the protection of technical measures and the digital preservation of libraries in the current copyright law of China. It is suggested to add restrictions and exceptions to technical measures applicable to libraries in the new legislative activities.
