Analysis on Hollowing-out of Japanese Library Law

Abstract:

After several amendments, statutory restrictions on Japanese library law have been abolished.Because of Act of NPO, Act of PFI and the introduction of designated administratorsystem, privatization and decentralization are affecting public libraries all over Japan. That’s why Japanese library law is becoming more and more hollowed. It is the result of little enforceability of the library law and neo-liberalism reform in Japan. Japan’s example leaves us with four lessons as follows: first, the special law should be adopted before the common law;second, the library law should have critical enforceability; third, privatization should be carried out ensuring that public interest is protected; and finally, downward accountability and upward accountability should be integrated.
