A Study of Obligations of Libraries to Safeguard Copyright: Based on Case Studies

Abstract:

When libraries provide service for users, but involve copyrights, they should shoulder responsibilities of protecting copyright holders’ interests as well, despite their legitimate right of using the literature in the meantime. Furthermore, whether libraries have assumed some obligations has become an important criterion of determining whether they infringe the copyrights or not. The paper analyzes several cases and clarifies the responsibilities and obligations of libraries, such as deleting links of infringement, putting up warnings of copyright infringement, obligations when signing contracts, fair use and statutory license.
