Review on Third Revision of the Copyright Law of P. R. China and the Progress of International Copyright Legislation

Abstract:

The third revision of the Copyright Law in P. R. China was launched in July 2011, and the third draft of the revision of the Copyright Law was submitted to the Legislative Affairs Office of the State Council P.R. China in December 2012 by the National Copyright Administration. Since 2005, limitations and exceptions has been an issue considered in the agenda of the WIPO Standing Committee on Copyright and Related Rights (SCCR), in order to discuss and adopt international treaty in relation to limitations and exceptions on libraries and archives, education and research institutions, and on disabled persons for accessing copyrighted works. Based on brief introduction to the third revision of the Copyright Law in P. R. China, the paper analyzes some related problems, extracts and reviews the recent progress of legislative practice on copyright limitations and exemptions organized by WIPO, so as to provide reference for the revision of the copyright law in P. R. China.
