The Effect of Three-Step Approach on the Fair Use of Libraries:Based on the 3rd Revision of Copyright Law

Abstract:

On July 13th, 2011, the 3rd revision of Copyright Law was officially started. As an important
medium to communicate information and knowledge, libraries and their suggestions deserve attentions in
the new context. The 3rd revision mainly covers standards of copyrights protection, scopes of exceptions and
limitations. Based on the analysis of the features of fair use, the author systematically analyzed the three-step
approach by interpreting the content, the scope of its application, the system and the basic rules of the three
criteria. The author attempted to enhance the libraries’ rights and to make sure the exercising of fair use rights
can be protected in the future.
