摘要：

在国家积极推行文化数字化战略的制度背景下，知识供给范式的革新，为图书馆履行其文化保障的社会职能提出了新要求。面对线下版权作品转化的海量需求，权利人选择在电子化作品上适用技术措施以规范线上资源的受控借阅，同时实现对版权侵权行为的预防。然而，技术措施的泛化适用亦对传统图书馆版权例外规则的运行产生阻碍，公众无法仅以合理使用为由主张对技术措施规避行为的侵权豁免。技术措施例外，作为数字环境下图书馆例外规则的本土制度续造，可通过对信息资源支配排他性的调节，恢复公众对信息的自由接触。在具体的制度安排上，应新增以“非营利性图书馆”为主体的技术措施例外，并协调其与既有合理使用类型的关系，同时注意避免合同规则对该例外的任意性排除。

Abstract:

With the policy of promoting digitization of cultural works in China, the innovation of howknowledge should be supplied generates new requirements for library to fulfill its social function of culturalsecurity. When facing the massive demand for the transformation of copyrighted works offline, copyrightowners chose to apply technical measures to electronic copyrighted works to regulate the controlled lendingof online resources and prevent copyright infringement in advance. However, the general applicationof technical measures also causes certain obstacles to the application of the traditional library copyrightexceptions. The public cannot claim the infringement exemption any more on the grounds of fair use. Theexceptions of technical measures, as a continuation of the local system of library exception rules in thedigital environment, can restore free access to information for the public by adjusting the exclusive controlof information resources. As to the specific institutional arrangement, legislators could add a new exceptionof technical measures for “non-profit library”, coordinating it with the existing types of fair use, and makingsure it would not be excluded from the private autonomy in contract.
