古籍点校成果的著作权保护模式研究

Research on the Copyright Law Protection Mode of Collation of Ancient Chinese Prose

摘要: 人类的智力劳动成果要满足著作权法意义上的“独创性”要件才能成为受保护的作品。 本文对古籍点校成果的可版权性问题展开研究,旨在探寻古籍点校成果的合理保护模式。通过著 作权法理分析,本文认为点校行为是满足“独”的标准的智力劳动行为,但其成果不满足“创” 的高度,而且在平衡利益、促进信息自由与文化繁荣的公共政策考量下,点校成果因其表达与思 想混同、还原事实(古文原意)而被著作权法排除在保护范围之外。点校行为是辅助性劳动,其 结果(点校本)是基于辅助工作的非创造性劳动产物。出版机构在组织点校活动过程中投入大量 人力、物力、财力等成本,因此对于点校成果及其投资者,可考虑通过邻接权制度进行保护。

Abstract: Intellectual efforts must have the “orginality” as defitied by copyright law in order to become a protected piece of work. This article conducts research on the “copyrightability” of the Collation of ancient chinese prose to explore a reasonable protection mode of such works. Based on the analysis of copyright law, this article identifies Collation of ancient chinese prose as an independent intellectual effort, but its results do not satisfy the “creativity” component as required by copyright law. In addition, out of the public policy considerations of balancing interests and promoting information freedom and cultural prosperity, the results of the Collation of ancient chinese prose should be excluded from the scope of protection by the copyright law because of them mixing expression of facts with the restoration of facts. Collation of Ancient Chinese Prose is auxiliary labor, and the result is a non-creative labor product based on auxiliary work. The publishing organization invests a lot of manpower, material resources, financial resources and other costs in organizing the Collation of ancient chinese prose, so the results of the Collation of ancient chinese prose and its investors may consider protection through neighboring right.
